Prodej software - licence
Pokud jsem koupil licenci na nějakou aplikaci pro PocketPC, je možné ji nějakým způsobem prodat dál? A jak vyřešit změnu "Owner Name".
Konkrétně se jedná o:
- mPhone Profesional
- SmartGSM
Koupil jsem je jako soukromá osoba, ale již je nepoužívám.

To bohuzel nelze. "Koupi programu" si uzavira dvoustranna dohoda mezi vami a vyrobcem programu, kterou nelze dale "prodat", protoze tu dohodu vzdy uzavira zakaznik s vyrobcem, nikdy zakaznik se zakaznikem. Nekupujete si totiz program, ale licenci na konkretni jmeno abyste program mohl pouzit.
S tím bych nesouhlasil. Koupím si právo užití programu (díla). Autorský zákon striktně nezakazuje toto právo poskytnout dál, ale je tam jedno omezení. Tento prodej/poskytnutí,... se nemusí řídit jen tímto zákonem, ale i licenčním ujednáním, které k němu může vykonavatel majetkových autorských práv vydat. Takže je potřeba se podívat na konkrétní licenční ujednání popřípadě kontaktovat přímo vykonavatele.

Jenze pokud ja jako zivnostnik prodam nekomu Windows XP v krabici, tak pouze zprostredkovavam smluvni vztah mezi uzivatelem a MS... ;)
Nee. Já předpokládám situaci, kdy si koupím krabicový MS produkt. Používám jej a pak nastane situace, kdy už jej nepotřebuji. Tak jej můžu normálně prodat, ale musím jej prodat komplet a samozřejmě odinstalovat:

Pýtal som sa na takúto situáciu ohľadom Dynavixu. Mám totiž v pláne kúpiť z druhej ruky navigačný set, ktorý ho obsahuje. Z Telematixu mi prišla odpoveď, že je to OK, pre nich som zákazník, ako keby som si to kúpil ja a mám teda nárok na podporu a upgrady po dobu jedného roku zdarma.
